Royal Decree establishing the site of Koh Ke

- the Constitution of the Kingdom of Cambodia,
- the Royal Decree n° NS/RKT/1198/72 of 30 November 1998 establishing the
Royal Government of the Kingdom of Cambodia,
- the Royal Kram n° 02/NS/94 of 20 July 1994 establishing and defining the
functioning of the Council of Ministers,
- Royal Kram n° NS/RKM/0196/26 of 25 January 1996 implementing the law on
the Protection of Cultural Heritage,
- the Royal Kram n° NS/RKM/1296/36 of 24 December 1996 concerning the protection
of environment and management of nature
- the Royal Kram n° NS/RKM/0196/02 of 24 January 1996 implementing the law
on the establishing of Ministry of Culture and Fine Arts
- the Royal Kram n° NS/RKM/0699/09 of 23 January 1999 implementing the law
on the establishing of Ministry of Land Management, Urban Planning and Construction
- the Royal Kram n° NS/RKM/0801/ of 30 August 2001 implementing the land
law
- the Royal Decree date 01 November 1993 establishing and defining the natural
protected zone
- the Royal Decree n° NS/RKT/0295/11 of 19 February 1995 redefining of the
Supreme Council on National Culture,
- The proposal of the Prime Minister for the Royal Government of Cambodia and
approved by the Council of Ministers at its plenary sitting on 27 February 2004
Order
Chapter 1- General provisions
Article 1: Establishing the cultural site of Koh Ke as the protected zones which
are in Srayang Commune, Kulen District, Preah Vihea Province.
Article 2: The purpose of establishing this site are
- Conservation of cultural heritage which is value of archaeology, anthropology,
history and improve the value of site as well as better protection
- Conservation the cultural landscape and development of touristic site
- Protection the natural environment in the region following by the geographical
situation today
Chapter 2 – Zoning
Article 3: Require to control all developments of site, follow the zoning plan
and manage the protection categories.
Article 4: The site of Koh Ke has been divided in three different protected
zones:
1.The middle zones: The zone consist of a huge temple called "Zone A"
and water reservoir (Rohal in Khmer) called " Zone B". The both areas
have been zoned as the following:
Zone A: The areas are in the longitudes and latitudes of
B1(450190, 1523180), A2(450100, 1523620)
A3(450730, 1523730), A4(450790, 1523280)
Zone B: The areas are in the longitudes and latitudes of
B1(450710, 1523226), B2(451245, 1523620)
B3(451608, 1522253), A4(451071, 1522106)
The middle zones consist of 92Ha 62A. The Zone A and B are the high protected
areas.
2. The secondary zone: It's an archaeological reserve, the areas rich in small
temples and archaeological remains or buried under the ground, in the forest
which are found by archaeologists or have not been found yet. That area consists
of 3507Ha 63A.The areas are outside zone A and B. They're in the longitudes
and latitudes of
C(448000, 1526000), D(448000, 1520000)
E(454000, 1520000), F(454000, 1526000)
The areas consist of archaeological remain; they have been protected and takes
action against the land use and non available development.
3. The third zones: The economic and society development areas which are preserved
job, costumes and believes as well as every day lives of population in the region.
These areas are 1500 meters from the longitudes and latitudes of CDEF. The areas
are the preservation target of cultural and natural heritage through the management
and development in continuously and the appreciation of the environment effect.
The zoning map of the site of Koh Ke can find in the appendix of this Royal
Decree.
Chapter 3 – Management, Preservation and Maintenance
Article 5: All conservations of each area is managed, preserved and maintained
following the categories of the area written in article 4 of this Royal decree.
It's established different value such as Archaeology, Anthropology, History,
Environment and Natural property. Recognize the properties and every day lives
of the local people in the whole area as well as improvement the site to be
more value.
Article 6: Applying the policy of Supreme Council on National Culture to ensure
the management, preservation and maintenance. The Ministry of Culture and Find
Arts, the institution which is responsible basing on the article 5 of the Law
on the Protection of Cultural Heritage implementing the Royal Kram no. NS/RKM/0196/26
of 25 January 1996.
The modality and legality of the management, preservation and maintenance of
the site of Koh Ke on the article above established by Sub decree.
Chapter 4 - Modification of Zoning
Article 7: The surrounding and all activities of the site of Koh Ke could be
re-control and modified relying on the result of the research of archaeologist
and present situation to ensure the economic and society development as well
as conservation and management continuously written in the article 4 of this
Royal decree.
The modification and all activities involved with the site of Koh Ke established
by the Royal decree through the proposal of Royal Government.
Chapter 5 – Final Provisions
Article 8: All provisions contrary to the present Royal Decree shall be considered
null and void.
Article 8: The Prime Minister of the Royal Government of the Kingdom of Cambodia shall be responsible for the execution of this Royal Decree from the signed date.
