Sub-decree concerning the Hotel Zone

The Royal Government, having regard to:

• the Constitution of the Kingdom of Cambodia,
• the Royal Decree of 1 November 1993 establishing the Royal Government of the Kingdom of Cambodia,
• the Royal Decree of 24 September 1993 appointing the First Prime Minister and the Second Prime Minister of the Royal Government,
• the Royal Decree NS/RKT/1094-83 of 24 October 1994 redefining the composition of the Royal Government of Cambodia,
• the Royal Decree NS/RKT/1094-90 of 31 October 1994 redefining the composition of the Royal Government of Cambodia,
• the Kram n° 2/NS/94 of 20 July 1994 establishing and defining the functioning of the Council of Ministers,
• the Royal Decree of 19 February 1995 establishing the Authority for the Protection and Management of Angkor and the Region of Siem Reap (APSARA),
• the Royal Decree of 23 May 1995 concerning Territorial Management, Urban Planning and Construction,
• the Royal Decree n° 001/NS of 28 May 1994 concerning the zoning and management of the region of Siem Reap/Angkor,
• the proposal of the Minister of State for Culture and Fine Arts, Territorial Management, Urban Planning and Construction,

Decides

Part 1 Hotel Zone

Article 1:

The whole zone " A " as circumscribed on the appended plan is the property of the Kingdom of Cambodia in Siem Reap and is hereby turned over to the APSARA Authority for management as a hotel zone. The hotel zone is comprised of 560 hectares situated between the following points:

• point 1: longitude 377400; latitude 1478000
• point 2: longitude 378150; latitude 1479700
• point 7: longitude 381000; latitude 1479720
• point 8: longitude 381000; latitude 1478000

Article 2:

As of the date of signature of this sub-decree, no right of use or ownership of any part of this zone may be legally granted or transferred.

Article 3:

All the lands in this zone are placed under the supervision of the Authority for the Protection and Management of Angkor and the Region of Siem Reap (APSARA), which shall be responsible for the management and conservation of the site, including the prevention of all further occupation, development and commercialization of said lands.

Article 4:

All those persons who, prior to the date of signature of this sub-decree, legally occupied one or more plots of land in this zone must make themselves known to APSARA within one year and show proof of legal occupation issued by competent authorities prior to said date.

Part 2 Particularly sensitive zones

Article 5:

In accordance with the Royal Decree n° 001 NS of 28 May 1994 concerning the zoning and management of Siem Reap/Angkor, and its explanatory report:

• having regard to urban conservation zones (Points 30, 31, 32), the strip of land lying along the axis of the N.R.6 (B), covering a width of 250 meters on each side of the road, is hereby declared a regulated zone;
• having regard to the protected banks of the Stung Siem Reap and the Stung Roluos (Point 39), the strips of land lying along the Stung Siem Reap (C) and the Stung Roluos, covering a width of 500 meters on each side of the rivers, are hereby declared protected zones;
• having regard to landscape and natural resource management, the area lying between the N.R.6 road to the south and the limit of the Zone 2 protected archaeological reserve to the north (D) is hereby declared a protected zone in the Archaeological Park.

Special measures will be applied to these zones.

Any move to divide or join together the existing plots of land in these zones, and any project to physically modify them in any way must first be submitted to APSARA for approval.

Article 6:

All provisions contrary to the present sub-decree shall be considered null and void.

Article 7:

The Minister of State for Culture and Fine Arts, Territorial Management, Urban Planning and Construction, the Co-Minister in charge of the Presidency of the Council of Ministers, and the concerned Ministers and Secretaries of State shall be responsible for the execution of the present sub-decree.

Article 8:

The present sub-decree shall come into effect as of the date of signature.
